The Law of Employment Discrimination, Cases and Materials(文景書局)

ISBN: 9781647089757 Year: 2024 Editon: 14 Price: US$ 279.00
Author: Joel Wm. Friedman
A b s t r a c t

This casebook covers all major aspects of employment discrimination law, including benchmark legislative, administrative, and judicial developments. Due in part to frequent updates and revisions, it has received accolades as one of the most comprehensive and frequently updated texts on the market. The 14th Edition continues this tradition by seamlessly incorporating all major legislative and judicial developments through July 2023, including all relevant decisions rendered by the Supreme Court in its 2022-2023 term. The major Supreme Court rulings were in Groff v. Dejoy and Students for Fair Admissions, Inc. v. President and Fellows of Harvard College. In Groff, a unanimous Court expanded an employer’s duty to accommodate religious beliefs and practices under Title VII by ruling that the standard of undue hardship requires a showing that the burden is substantial in the overall context of an employer’s business, including an assessment of the impact on the coworkers. Instead of having to prove only the incurring of a de minimis expense, an employer now must show the burden is excessive or unjustifiable. In Students for Fair Admissions, a non-employment case, a six-member majority ruled that the use of race in the admissions policies of the two defendants (Harvard and the University of North Carolina) violated the Equal Protection Clause of the Fourth Amendment. Applying strict scrutiny to the defendant’s acknowledged use of race in their admissions processes, the Court ruled that these programs failed both the compelling interest and narrowly tailored components of strict scrutiny.

In this edition, the authors preserve the relative simplicity and compact coverage of an introductory employment discrimination law casebook in a field that continues to grow ever more complex. Keeping the larger questions in view, and the controversial arguments that surround them on all sides, remains a challenge as cases and statutes raise ever more finely-tuned issues of doctrine. This edition keeps readers abreast of recent developments, assesses what they hold for the future of employment discrimination law, and introduces the issues in a field of continuing vitality and controversy.

For over 30 years, students, academics and professionals have relied on Macken’s Law of Employment as Australia’s most respected work in employment law. Authored by a distinguished team of experts, the scholarly commentary provides reliable guidance on all aspects of employment law.

In recognition of the extensive influence of the Fair Work Act 2009 (Cth) on the rights and responsibilities of employers and employees, this edition organises chapters into two parts – the first dealing principally with a thorough analysis of common law principles applying to the employer-employee relationship, and the second with the statutory provisions governing employment, although always with careful attention to the intersections and overlaps between common law and statute.

The objective of this book, and undeniably its greatest strength, is to provide expert and up-to-date commentary on this continually evolving area of law. It is an essential tool for those studying or working in employment law.

Experiencing Employment Discrimination Law is written by two seasoned practitioners, one of whom is a law professor. The book is designed as both a tool of pedagogy as well as a book that students can take into practice. It begins with six “Threshold Questions” that must be asked and answered before a lawyer proceeds to determine whether the law has been violated. Other books bury these issues in unrelated sections; this book ties them together in one place. Before each case throughout the book, the authors include “X-Ray Questions” to help students understand what they should be asking themselves as they read the case. This feature allows instructors to spend less time laying the groundwork for understanding a case and more time discussing the case’s import. The book also has many “Leaning Into Practice” sections based on challenging real-world fact patterns, which are designed to allow students to gain competence and confidence. These exercises can also be done in the classroom for instructors who want an alternative to the traditional case-summary method of teaching. Case selection focuses much more on interesting and engaging fact patterns and much less on stodgy majority, concurring, and dissenting Supreme Court opinions. These are the types of cases that practicing lawyers will use and interpret in their daily work. Through its “Beyond the Cite” sections, the book looks at a wide variety of contemporary issues such as whether prohibitions on certain hair styles constitute a proxy for racial discrimination. The mix of cases, exercises, and reading materials will provide a stimulating fulcrum to meet the pedagogical goals of different instructors. The book is written in a down-to-earth, highly readable style that will resonate with students, while still demonstrating a commitment to deep intellectual rigor.

The Seventeenth Edition makes a number of significant changes to its predecessor, reflecting the evolution of the law relating to employers, employees, and unions in a dynamic economy and polarized political environment. This edition includes new decisions of the National Labor Relations Board appointed by President Trump, which has departed in many, significant ways from the approach of the Board under the Obama Administration. The Trump Board’s starkly different outlook on the role of labor law in the contemporary workplace is reflected in its overturning or reversing precedents on many key issues, such as protections for employee electronic communications, accountability for employers in “fissured” enterprises, and treatment of various other employer restrictions on collective employee activity. The book also contains judicial decisions addressing these developments, evincing the growing conflicts over the role of labor unions in society.

This textbook is a one-volume treatment of the basic analytical structure and legal policy issues informing U.S. employment law. Introductory chapters are also included on the economic analysis of employment regulation, employment discrimination, union organization, and collective bargaining laws. The book is designed as a complement for all leading casebooks on employment law, in that it approaches the issues in a comprehensive manner that will enable the student to understand how these laws interact in particular cases. Unlike other employment law treatises, this book moves well beyond the descriptive to empower the student in tackling difficult analytical and policy issues in the field.

This book provides an introduction to the field of employment discrimination law, both at the abstract level of theory and at the concrete level of doctrine. It is as much an introduction for experienced lawyers and scholars who come to this field with a thorough knowledge of other aspects of the law as for law students who have just begun preparing for their careers. The leading decisions of the Supreme Court receive a comprehensive analysis, in terms both of theory and doctrine, putting them in the context of the relevant statutory provisions and other judicial decisions. This book offers three different theoretical perspectives–based on history, economics, and critical social theory–to explain both the complexities and the tensions inherent in existing law.

The new edition of this book addresses several major developments in the field, which have gone in two different directions: towards broader and more general prohibitions, and at the same time, towards exceptions recognized on a variety of grounds. The broad trend is epitomized by the Supreme Court’s interpretation of Title VII’s prohibition against sex discrimination to include discrimination on the basis of sexual orientation and gender identity. The Supreme Court took this step in the wake of constitutional decisions legitimizing gay and same-sex marriage. It also acted despite the repeated failure of bills in Congress that would have explicitly prohibited employment discrimination on the basis of sexual orientation and gender identity. The restrictive tendency is evident in decisions recognizing and expanding the constitutional right of religious organizations to choose ministers and teachers of faith regardless of the laws against employment discrimination. All of these major developments, and others as well, are covered in the new edition of this book.

Each chapter contains numerous court and agency decisions, including landmark cases, turning points in the law, and issues of current significance. Each decision is followed by case questions to guide the student through the opinion and to assist in identifying the issues and arguments. Extensive end-of-chapter case problems enable students and instructors to apply lecture content and case principles to real life disputes between labor and management and employees and employers.
